I am wondering if this is intentional or not:

Basically i am wondering if I wear a +95, -40 and +40 should the +40 and -40 cancel each other out leaving me with 95 (it does not now) or do we intentionally add all the + items (+95 +40 = +96) and subtract the -40 leaving me with 56?

My understanding of it, that is intentional.

Penalties always apply last or after all the resistance(s) values are calculated.

As far as I understand it, resistance bonus /multiply/, and the penalties also multiply, then they are added, at least that is what has been consistant with my experience with them.
eg res +30 and res +40 would give res of 30 + 40*(100-30) = 58

Yes, they multiply.

As far as I remember, 95% is special, in that it puts you at 95% straight, though (would need to check code to make sure).

But race/god negative resistances come in play after.

Well when I don my cloak of magidc resist +95 magic resist it stacks with my natural resist, giving me 96 or 97, but then the -'s for my ring of war is subtracted out

This seems to be how it was intended
